Bike Queenstown – Terms and Conditions
These Terms and Conditions (“Terms”) govern all bookings made with Bike Queenstown Limited (NZ company) trading as Bike Queenstown (“we”, “us”, “our”). By making a booking with us, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Role of Bike Queenstown –
Booking Agent Only
1.1 Bike Queenstown acts solely as a booking agent for third‑party suppliers and service providers, including but not limited to accommodation providers, bike hire companies, guiding operators, shuttle operators, heli‑biking operators, and activity providers (together, the “Third‑Party Providers”).
1.2 Bike Queenstown does not own, operate, control, or provide any accommodation, bike hire, guiding, transport, heli‑biking, or other services advertised or booked through our website or booking system.
1.3 Your contract for the provision of accommodation, bike hire, guiding, transport, heli‑biking, and all other services is directly with the relevant Third‑Party Provider, not with Bike Queenstown.
1.4 By booking through Bike Queenstown, you acknowledge and agree that:Each Third‑Party Provider has its own terms and conditions, including cancellation, refund, liability, and safety policies;You are bound
by, and agree to comply with, the applicable Third‑Party Provider terms and conditions;Bike Queenstown accepts no responsibility or liability for the acts, omissions, negligence, or failures of any Third‑Party Provider.
2. Assumption of Risk & General Liability Waiver
2.1 Mountain biking and related activities (including but not limited to guided riding, shuttle access, heli‑biking, and back‑country riding) are inherently hazardous activities and involve significant risks, including serious injury, permanent disability, or death.
2.2 By making a booking and/or participating in any activity arranged through Bike Queenstown, you acknowledge that:You are aware of the inherent risks associated with mountain biking and outdoor activities;You voluntarily accept and assume all such risks, whether foreseeable or unforeseeable;Environmental hazards, weather conditions, terrain, equipment failure, and human error may contribute to accidents or injuries.
2.3 To the fullest extent permitted by New Zealand law, you release, waive, discharge, and indemnify Bike Queenstown Limited, its directors, officers, employees, contractors, and agents from all claims, demands, actions, losses, damages, costs, or liabilities arising from:Personal injury, illness, death, or property damage;Participation in any activity arranged through Bike Queenstown;Any act or omission of a Third‑Party Provider;Any negligence (except where liability cannot legally be excluded)
.3. Insurance Requirement
3.1 It is mandatory that all participants hold adequate personal insurance that covers, at a minimum:Medical expenses;Emergency evacuation and mountain rescue;Personal accident and death;Loss, theft, or damage to bicycles and personal equipment.
3.2 Bike Queenstown does not provide insurance and accepts no responsibility for losses arising from inadequate or invalid insurance.
4. Bookings for Groups and Minors
4.1 Where a booking is made on behalf of a group, the person making the booking (the “Group Leader”) warrants that they have authority to bind all participants to these Terms.
4.2 Where minors are included in a booking:The Group Leader acknowledges that they cannot waive a minor’s legal rights;The Group Leader accepts full responsibility for all medical expenses and related costs incurred by the minor;To the fullest extent permitted by law, the Group Leader agrees to indemnify Bike Queenstown and its partners against any claims brought on behalf of the minor.
5. Cancellations and Refunds (Customer‑Initiated)
5.1 All cancellation requests must be submitted in writing via email by the Group Leader.
5.2 The following cancellation policy applies unless otherwise stated at the time of booking:Within 48 hours of making a booking: 100% refundMore than 80 days before arrival date: 50% refund80 days or less before arrival date: No refund
5.3 Refunds are processed only where permitted under these Terms and applicable Third‑Party Provider terms.
6. Changes or Cancellations by Bike Queenstown
6.1 In rare circumstances beyond our reasonable control, Bike Queenstown may need to amend or cancel a confirmed booking.
6.2 Where a booking is cancelled by Bike Queenstown (and not due to Force Majeure), our maximum liability is limited to a refund of monies paid to us. No additional compensation will be payable.
6.3 Bike Queenstown may cancel bookings within a 48‑hour grace period to avoid double bookings. Customers will be notified promptly.
7. Force Majeure
7.1 Bike Queenstown is not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government actions, border restrictions, strikes, or supplier failure (Force Majeure).
7.2 In Force Majeure events, refunds, credits, or alternative arrangements are subject to Third‑Party Provider policies and may not be available.
8. Accommodation (Third‑Party Providers)
8.1 All accommodation is provided by independent Third‑Party Providers.
8.2 While Bike Queenstown undertakes reasonable checks at the time of assessment, we do not control or manage accommodation properties and accept no liability for:Property condition;Safety compliance failures;Acts or omissions of accommodation providers.
8.3 Any accommodation issues must be reported promptly so we may liaise with the provider on your behalf.
9. Damage, Security Deposits & Behaviour
9.1 A damage/security deposit may be required. Where no deposit is taken, Bike Queenstown reserves the right to charge for damages using payment details held on file.
9.2 Guests are fully liable for the full cost of any damage, loss, theft, vandalism, or nuisance caused by them or their group.
9.3 Where responsibility cannot be attributed to a single individual, charges may be apportioned across the group.
9.4 Bike Queenstown reserves the right to terminate accommodation or services without refund where behaviour:Endangers others;Causes damage;Disrupts the enjoyment of other guests
.10. Bike Hire (Third‑Party Providers)
10.1 Bike hire services are supplied by independent Third‑Party Providers.
10.2 Bike Queenstown accepts no liability for equipment condition, failure, or suitability. Any issues must be raised immediately.
11. Guiding, Shuttles & Heli‑Biking (Third‑Party Providers)
11.1 All guiding, shuttle, and heli‑biking services are provided by independent Third‑Party Providers.
11.2 Participation is at your own risk. Adequate insurance is mandatory.
11.3 Bike Queenstown does not guarantee safety outcomes and is not liable for incidents arising from these services.
12. Personal Property
Bike Queenstown is not responsible for loss, theft, or damage to personal belongings, vehicles, or equipment at any accommodation or Third‑Party Provider premises
.13. Complaints
Complaints should be raised as soon as reasonably possible and emailed to info@bikeqt.com. We aim to respond within 14 business days.
14. Website Information
While we take reasonable care to keep our website accurate and up to date, information may change. Bike Queenstown does not warrant absolute accuracy at all times.
15. Privacy & Marketing
Information provided to Bike Queenstown may be used in accordance with our Privacy Policy, including for marketing communications where consent has been given.
16. Governing Law
These Terms are governed by the laws of New Zealand. New Zealand courts have exclusive jurisdiction.
17. Amendments
Bike Queenstown reserves the right to amend these Terms at any time. The version in force at the time of booking will apply.
By completing a booking, you confirm acceptance of these Terms and all applicable Third‑Party Provider terms and conditions.
